By agreeing to the terms and conditions set forth here, you confirm that you are at least 18 years of age, have read and understand the statements herein, and are competent to make this agreement. 

1. Your Acceptance of Terms 

These terms and conditions (the “Terms & Conditions,” or “Agreement”) constitute an agreement made between Price Morgan DBA Ready Set Debate (hereinafter “Ready Set Debate”; a Texas sole proprietorship with a mailing address of P.O. Box 515631, Dallas TX 75251) and the person or entity (hereinafter “you,” or “customer”) purchasing access to Ready Set Debate services and/or products. You can agree to these Terms & Conditions by: a) actually accessing Ready Set Debate services and/or products, or b) checking your online order form indicating you agree to the Terms & Conditions for accessing these services and/or products, or c) checking the “I Agree” box where such a box is made available to you.

2. Fees 

The current fees for accessing different Ready Set Debate services and products (e.g. debate clubs, camps, tournaments, one-on-one coaching, other coaching services, and curriculum materials) are outlined on the respective pages for those services and products on the Ready Set Debate website <https://readysetdebate.com>. There is a one-time registration fee for accessing some services and products, as outlined on the pages for those services and products. If your payment(s) for any services and/or products lapse(s) through lack of payment or cancellation, this set-up fee may be charged again if you wish to access the services and/or products again.

Fees for Ready Set Debate services and/or products will be automatically billed to your designated credit card account or other authorized billing source (e.g., debit card, PayPal) as authorized upon your purchase of access to the services and/or products. For ongoing Ready Set Debate services (e.g. Ready Set Debate clubs), billing is monthly. If you use a debit card as the designated credit card account, you acknowledge that Ready Set Debate will not be responsible for any fees or penalties associated with insufficient funds, bounced checks or any other form of fee due to a charge by Ready Set Debate to a debit card provided by you. If you receive ongoing Ready Set Debate services (e.g. a Ready Set Debate club), Ready Set Debate will automatically renew your payments at the end of your payment term as authorized upon registration, and bill the fee to the designated billing source, until you cancel your payments and withdraw.

3. Refund policies for specific services and products

You have the right to request a refund of payments made to Ready Set Debate for Ready Set Debate services and/or products under certain circumstances. You may request a refund by emailing info@readysetdebate.com. 

The general policy of Ready Set Debate is to provide a full refund for payments, less any portion of the payment covering products and/or services already provided at the time of the refund request, if the refund request is received within 30 days after the payment was made. In cases when Ready Set Debate administratively expels a student, a refund will be automatically provided for any portion of the payment made for services and/or products not yet provided, excluding any portion of an activity meeting missed due to the coach and/or administrator’s decision to eject the student during the meeting. Here are details of and exceptions to this policy as it applies to specific products and services Ready Set Debate provides:

• CLUBS: Ready Set Debate will provide no refunds for club registration fees.
  
• CAMPS AND WORKSHOPS: Regardless of when payment was tendered, Ready Set Debate will provide a full refund for camps and workshop tuition until 30 days before the first session, and a refund less $100 until 72 hours before the first session. Ready Set Debate will provide no refunds within 72 hours of the first session. 
  
• TOURNAMENTS: Regardless of when payment was tendered, Ready Set Debate will provide a full refund for tournament registration fees and judging waiver fees until 7 days before the tournament start time, and a half refund until 72 hours before the tournament start time. Ready Set Debate will provide no refunds within 72 hours of the tournament start time.
• ALL OTHER SERVICES AND PRODUCTS: Ready Set Debate may provide refunds at its sole discretion.  

4. Right to Cancel

You have the right to terminate your right to access Ready Set Debate services at any time. You may terminate your right to access Ready Set Debate services by emailing info@readysetdebate.com and expressing your intention to terminate your right to access Ready Set Debate services. 

5. Content Moderation

“Content” means any information that may be generated or encountered through your use of Ready Set Debate services and/or products, such as data files, written text, software, music, graphics, photographs, images, sounds, videos, messages and any other like materials. You acknowledge that Ready Set Debate is not responsible or liable in any way for any Content provided by you and/or others, including others who have purchased or otherwise gained access to Ready Set Debate services and/or products, and has no duty to pre-screen such Content. However, Ready Set Debate reserves the right at all times to determine whether Content is appropriate and in compliance with these Terms & Conditions, and may pre-screen Content at any time, and revoke access to Ready Set Debate services without prior notice and at its sole discretion, if such Content is found to be in violation of these Terms & Conditions or is otherwise objectionable.

6. Copyright Provisions 

You agree at all times to honor all applicable copyright law with respect to Ready Set Debate services and/or products. You may not duplicate, license, sublicense, publish, broadcast, transmit, distribute, perform, display, sell, rebrand, otherwise transfer or commercially exploit Ready Set Debate materials except as specifically authorized in writing by Ready Set Debate. You may not remove any copyright, trademark or other proprietary rights notices contained in or on Ready Set Debate materials. You may not infringe or use the Ready Set Debate brand, logos and/or trademarks without specific authorization. Ready Set Debate may, at its sole discretion, suspend and/or revoke the access to Ready Set Debate services and/or products of customers and/or others that are found to be infringers of copyrighted materials.

7. Termination by Ready Set Debate

Ready Set Debate may at any time, under certain circumstances and without prior notice, immediately revoke or suspend all or a portion of your access to Ready Set Debate services and/or products. Cause for such revocation shall include, but not be limited to: (a) violations of the Terms & Conditions or any other policies or guidelines that are referenced herein and/or posted about your access to Ready Set Debate services and/or products; (b) a request by you to cancel or terminate your association with Ready Set Debate; (c) discontinuance or material modification to Ready Set Debate services and/or products or any part thereof; (d) a request and/or order from law enforcement, a judicial body, or other government agency; (e) where provision of Ready Set Debate services and/or products to you is or may become unlawful; (f) unexpected technical or security issues or problems; (g) your participation in fraudulent or illegal activities; or (h) failure to pay any fees owed by you in relation to your access to Ready Set Debate services and/or products. Any such termination or suspension shall be made by Ready Set Debate at its sole discretion, and Ready Set Debate will not be responsible to you or any third party for any damages that may result or arise out of such termination or suspension of your access to Ready Set Debate services and/or products.

Ready Set Debate reserves the right, at its sole discretion, to refuse to honor any request for access to its services.

8. Release of Media 

Ready Set Debate, its employees, and/or its agents have the right to take photographs, videotape, or digital recordings of you and/or your child(ren), during scheduled Ready Set Debate events and activities, and to use these in any and all media, now or hereafter known. You further consent that your name and your child(ren)’s names and identities may be revealed therein or by descriptive text or commentary. You do hereby release to Ready Set Debate and its agents and employees all rights to exhibit this work in print and electronic form publicly or privately and to market and sell copies. You understand that there will be no financial or other remuneration for recording you or your child(ren), either for initial or subsequent transmission or playback. You also understand that Ready Set Debate is not responsible for any expense or liability incurred as a result of your participation in this organization or recording, including medical expenses due to any sickness or injury incurred as a result. This assurance and commitment shall survive the termination or expiration of this Agreement.

9. General Release

Each person with access to Ready Set Debate services and/or products, for himself/herself, and on behalf of any person who uses Ready Set Debate services and/or products (for example, students in Ready Set Debate programs), hereby forever releases, acquits and discharges Ready Set Debate from any and all liabilities, claims, demands, actions and causes of action that such person or such person’s legal representatives may have by reason of any monetary damage or personal injury sustained as a result of or during the use of Ready Set Debate services and/or products. The sole recourse available to the person, person’s beneficiary, or their legal representatives shall be the cancellation of access to Ready Set Debate services and materials.

10. Governing Law 

Except to the extent expressly provided in the following paragraph, these Terms & Conditions and the relationship between Customer and Ready Set Debate shall be governed by the laws of the State of Texas, United States of America, excluding its conflicts of law provisions. You and Ready Set Debate agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Dallas, Texas, to resolve any dispute or claim arising from these Terms & Conditions.
